The apex court upheld merit-based admissions for PG medical programmes held through the NEET PG exam.

The matter was heard by a bench of Justice Hrishikesh Roy, and Justices Sudhanshu Dhulia and SVN Bhatti, who ruled that "residence-based reservation in Post Graduate (PG) medical courses is clearly violative of Article 14 of the Constitution."

Furthermore, the court clarified that the students who have already received admission based on domicile reservation will not be impacted by this ruling.

The court added that the state-quota seats should be filled out on the basis of the student's performance in the NEET PG exam.

The court added that providing a domicile reservation for state quota seats would be "unconstitutional."

"We are all domiciles in the territory of India. There is nothing like a provincial or state domicile. There is only one domicile. We are all residents of India. We have the right to choose residence anywhere in India and to carry out trade and profession anywhere in the country. The Constitution also gives us the right to choose admission in educational institutions across India,ph143" the apex court observed.
